Section 8
Tradable specimen of protected wildlife or flora –
(1) Any person, institution or body who wants to nurture protected wild animals or plant, grow protected plants or keep with them, use, produce, trade as seeds, transport or export or import such wild animals or plants must obtain a permit. However, no person is required to obtain such a permit to plant protected plants on private land, to grow protected plants that have been so planted and grown naturally on private land, to produce, keep and use samples thereof.
(2) A person, organization or entity who wants to obtain a permit according to sub-section (1) shall submit an application to the management body as prescribed.
(3) If an application is received in accordance with sub-section (2), the management body may issue a permit as prescribed for any or all of the purposes under sub-section (1) and if it is convinced of the following matters upon investigation:-
(a) If a permit is requested for an activity other than breeding, if it is found that such wild animal or plant or its specimen is owned or controlled by the person, institution or agency requesting the permit,
(b) In case of a request for a permit for activities other than breeding, if it is found that the person, institution or body requesting the permit for such wild animal or plant or its specimen has received it in accordance with the prevailing law,
(c) if there is reason to believe that adequate arrangements are made for the transportation of live wild animals and that they will not be injured, injured, harmed or cruelly treated during their transportation.
(4) When granting a permit in accordance with sub-section (3), the management body shall, according to the requirements, keep, use, nurture, plant, grow and produce such wild animals or plants or its specimens as seeds. Route, mode of transport, accommodation and other necessary for carrying on trade, transportation or export or importIt can set conditions on the subject and it will be the duty of the person, institution or agency that has received the relevant license to comply with such conditions.
(5) If the conditions under sub-section (4) are not complied with, the management body may cancel such permit at any time after completing the prescribed procedure.
(6) The duration, renewal, cancellation, fee and other provisions related to the procedure of the permit granted in accordance with this section shall be as prescribed.
